You authorize Psyoniq Financial and NSS Projects, LLC to process information collected or otherwise lawfully obtained for the following purposes:

Optional uses, including certain marketing, profiling, or other secondary processing, will be subject to additional choices or consent where required.

6. Authorization to Store and Retain Data

By accepting these Terms, you authorize Psyoniq Financial and NSS Projects, LLC, together with their authorized service providers, to electronically store information necessary to operate the Services.

Information may be maintained using secure cloud infrastructure, databases, and other authorized information systems.

We may store information for the following purposes:

  • Maintaining user accounts and service continuity.
  • Providing historical financial reports and analytics.
  • Supporting financial performance tracking.
  • Protecting Platform security and integrity.
  • Complying with applicable laws and legal obligations.
  • Resolving disputes and enforcing contractual rights.
  • Maintaining backups and disaster recovery capabilities.
  • Data Retention: We retain personal information only for as long as reasonably necessary for the disclosed purposes, or as otherwise required or permitted by applicable law.

Following account termination or a valid deletion request, information will be deleted, deidentified, or retained only where a lawful basis exists, including legal obligations, security, fraud prevention, or dispute resolution. Residual backup information may remain temporarily under documented retention procedures.

7. Financial Account Connections and Third-Party Data Access

Psyoniq Financial may offer the ability to connect financial accounts through third-party financial data aggregation providers, such as Plaid or other authorized providers.

Connecting financial accounts is voluntary unless a particular feature expressly requires such connectivity.

Before initiating a connection, Psyoniq will present the applicable connection process and any required disclosures or authorization requests.

By separately authorizing a financial account connection, you permit the relevant financial data provider and Psyoniq Financial to access and process the financial information identified during the authorization process for the disclosed purposes.

Depending on the connection and permissions granted, this information may include:

  • Account ownership and identification details.
  • Account balances.
  • Transaction histories.
  • Account types.
  • Income and cash flow information.
  • Other expressly authorized account information.

Psyoniq will access connected financial information only within the scope of the applicable authorization and law.

Your financial institution and the aggregation provider may maintain separate terms and privacy policies.

You may request disconnection of linked financial accounts through available Platform controls or by contacting Psyoniq. Disconnection will stop future access through that connection, subject to technical processing and applicable requirements, but will not necessarily delete information previously collected. You may separately request deletion of retained information.

Psyoniq will not initiate fund transfers, withdraw funds, or execute financial transactions solely on the basis of an authorization to access financial data. Any future transaction functionality would require separate disclosures and appropriate authorization.

8. Data Sharing and Disclosure

Psyoniq Financial and NSS Projects, LLC may disclose personal information to authorized third parties when reasonably necessary for legitimate and disclosed purposes.

Such recipients may include:

  • Cloud hosting and data storage providers.
  • Financial account aggregation providers.
  • Authentication and cybersecurity providers.
  • Software infrastructure and analytics providers.
  • Customer support service providers.
  • Payment processors, where applicable.
  • Professional advisers subject to confidentiality obligations.
  • Government authorities or other parties where disclosure is legally required.

We require service providers handling personal information on our behalf to maintain appropriate confidentiality, security, and contractual protections, consistent with applicable law.

Psyoniq does not obtain a general right to sell, license, or commercially exploit identifiable consumer financial information merely because a consumer accepts these Terms.

Any sale, sharing for targeted advertising, or other use requiring a separate legal notice, opt-out opportunity, or affirmative consent will be handled in accordance with applicable law.

We may use or disclose properly aggregated or deidentified information for research, statistical analysis, product development, and performance benchmarking, provided appropriate measures are maintained to prevent identification or reidentification as required by law.

9. Data Security

Psyoniq Financial and NSS Projects, LLC will implement and maintain reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of information processed and applicable legal requirements.

Such measures may include:

  • Encryption during transmission and storage.
  • Authentication and access management.
  • Role-based access controls.
  • Monitoring and security logging.
  • Security testing and vulnerability management.
  • Vendor security assessments.
  • Backup and recovery procedures.
  • Incident response procedures.

No internet-based system can guarantee absolute security.

If a security incident involving personal information occurs, Psyoniq will investigate and provide notifications to affected individuals and appropriate authorities when required by applicable law.

10. Consumer Data Rights and Choices

Subject to applicable law, you may have rights to:

  • Request access to personal information maintained about you.
  • Request correction of inaccurate personal information.
  • Request deletion of eligible personal information.
  • Obtain a copy of certain personal information in a portable format.
  • Withdraw consent for processing that depends on your consent.
  • Disconnect linked financial accounts.
  • Opt out of certain marketing communications or data uses.
  • Exercise applicable rights concerning targeted advertising, profiling, or the sale or sharing of personal information.
  • Appeal certain decisions concerning privacy requests where required by law.

To exercise your rights, contact Psyoniq through the privacy contact method published on its website or Privacy Policy.

We may verify your identity before fulfilling requests and may deny or limit requests where legally permitted or required.

Withdrawal of consent does not invalidate processing lawfully conducted before withdrawal.

If you withdraw consent necessary to provide a particular feature, that feature may become unavailable.

Psyoniq will not unlawfully discriminate against consumers for exercising their privacy rights.

11. Financial Information and Educational Disclaimer

Psyoniq Financial is designed to support financial education, financial wellness, and informed financial decision-making.

Unless expressly stated otherwise in a separate legally compliant agreement, Psyoniq does not provide individualized investment advisory, securities brokerage, banking, legal, or tax services.

Certain Psyoniq features may use statistical models, machine learning, or artificial intelligence to analyze financial behaviors and provide personalized insights.

You acknowledge that:

  • Automated outputs may contain errors or inaccuracies.
  • Financial assessments may rely on incomplete or outdated information.
  • Financial scores are proprietary analytical measures unless otherwise disclosed.
  • Automated recommendations are not guaranteed predictions of future outcomes.
  • Material financial decisions should be independently evaluated.

Where required by law, Psyoniq will provide additional information or rights relating to automated decision-making and profiling.

13. User Responsibilities and Prohibited Activities

You agree not to:

  • Provide fraudulent or materially misleading information.

Psyoniq may suspend or terminate accounts for material violations, subject to applicable law.

14. Fees, Subscriptions, and Payments

Some Psyoniq services may be offered through paid subscriptions or other payment arrangements.

Where applicable, the Platform will disclose pricing, billing frequency, renewal terms, and cancellation procedures before purchase.

Recurring subscriptions will be subject to separate checkout disclosures and any affirmative authorization required by applicable law.

Users may cancel subscriptions through the available cancellation method.

Refunds, renewals, and billing adjustments will be governed by the disclosed subscription terms and applicable consumer protection laws.

15. Intellectual Property

The Psyoniq Financial name, branding, software, dashboards, educational materials, financial performance methodologies, algorithms, content, and related intellectual property are owned by NSS Projects, LLC or its licensors, except where otherwise expressly indicated.

Subject to these Terms, users receive a limited, nonexclusive, nontransferable, revocable license to access and use the Services for their intended purposes.

Users retain ownership of information they lawfully submit to the Platform.

By submitting information, users grant NSS Projects, LLC a limited, nonexclusive right to host, process, analyze, reproduce, and otherwise use that information only as necessary for the Services and other purposes lawfully disclosed and authorized.

This license does not transfer ownership of consumer data to NSS Projects, LLC.

16. Third-Party Services

Psyoniq may integrate with external financial institutions, technology platforms, payment processors, and other providers.

Third-party services may be governed by separate agreements and privacy notices.

Psyoniq is not responsible for the independent actions of third parties outside its control, except to the extent responsibility is imposed by law or arises from Psyoniq's own obligations.

17. Disclaimers and Limitation of Liability

To the extent permitted by applicable law, the Services are provided on an "as available" and "as is" basis, without warranties beyond those expressly stated or required by law.

NSS Projects, LLC does not guarantee uninterrupted access, error-free operation, or particular financial outcomes.

To the extent permitted by law, NSS Projects, LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable statutory privacy and data security obligations, fraud, willful misconduct, or other nonwaivable rights.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify NSS Projects, LLC against third-party claims arising from your unlawful use of the Services, intentional misconduct, or material violation of these Terms.

This provision does not require you to indemnify the Company for its own negligence, unlawful conduct, or breach of applicable obligations where such indemnification is prohibited by law.

19. Account Termination and Data Deletion

You may stop using the Services and request account closure at any time.

Upon closure, Psyoniq will terminate ordinary account access and process associated personal information in accordance with its Privacy Policy, retention practices, and applicable legal obligations.

NSS Projects, LLC may suspend or terminate access where reasonably necessary to address security threats, unlawful conduct, or material contractual violations.

Where appropriate, we will provide notice and an opportunity to resolve the issue.

20. Changes to These Terms

NSS Projects, LLC may modify these Terms to reflect changes in Services, technology, business practices, or legal requirements.

Updated Terms will be published with a revised effective date.

Where required by law or appropriate due to material changes, we will provide advance notice and obtain renewed consent.

Materially expanded data processing activities will not be justified solely by posting revised Terms where additional authorization is legally required.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles, except where mandatory consumer protection or privacy laws require otherwise.

Disputes arising under these Terms will be resolved in courts of competent jurisdiction, subject to applicable law and any separately agreed lawful dispute resolution procedure.

Nothing in these Terms limits a consumer's right to seek remedies from governmental authorities or exercise nonwaivable statutory rights.

22. Privacy Policy

The Psyoniq Financial Privacy Policy supplements these Terms and provides additional information about personal information practices, retention, third-party disclosures, consumer rights, and available privacy choices.
